CHHATTISGARH: Court shock to 7 teachers!
Dhamtari. Seven LB teachers and lecturers posted in the Kurud block of Dhamtari district have received a major setback from the Chhattisgarh High Court. The court completely rejected their demand for a pay promotion, making it clear that they are not entitled to this benefit under current rules.
A single bench of Justice BD Guru stated that the High Court had already ruled on this legal issue, and therefore, there was no basis for granting fresh relief. The court dismissed all petitions, upholding the state government's March 10, 2017, circular.
The case involved seven teachers and lecturers posted at various schools in the Kurud development block. These employees claimed they should receive promotions after completing a prescribed period of service, but the department rejected their claims.
They had approached the High Court challenging this decision. The court heard all the petitions together because they had similar facts and legal points.
The state government argued that the issue of granting promotions to teachers in the LB category has already been decided by a division bench of the High Court. Citing the cases of Abha Namdev v. State of Chhattisgarh and Pushpalata Manikpuri v. State of Chhattisgarh, the government stated that such claims have been rejected before.
The High Court held that the Kurud teachers' case was entirely consistent with those decisions. Based on this, the court dismissed the writ petitions of all seven teachers.
After this decision, it is also being considered an important legal signal for other employees of LB cadre that the claim for promotion pay scale under the circular of 2017 will not be accepted.
