Chhattisgarh High Court gave an important decision in the case of husband-wife dispute and divorce.
The Chhattisgarh High Court has issued an important ruling in a marital dispute and divorce case. A division bench of Justices Sanjay K. Agarwal and Sanjay Kumar Jaiswal held that cruelty cannot be proven in the absence of evidence, and that if an incident did occur, the husband later forgave the victim.
Furthermore, according to Section 23(1)(b) of the Hindu Marriage Act, if cruelty is condoned, it is not grounds for divorce. The High Court upheld the Family Court's order in the case and dismissed the husband's appeal.
In fact, a young man from Janjgir married a woman from Sargaon in Mungeli district on December 11, 2020. Their daughter was born in October 2022, after which tensions between the two wives began to rise. A dispute then ensued.
The husband alleged that he received abusive calls from three unknown numbers and threatened to make his wife's alleged pornographic videos viral. The husband alleged that his wife left the home on March 29, 2023.
The family court dismissed the case due to lack of evidence.
Following this, on April 4, 2023, the husband filed an application in the Family Court seeking divorce under the provisions of the Hindu Marriage Act. After hearing the husband and wife's arguments, the Janjgir Family Court dismissed the petition on August 20, 2024, stating that cruelty on the part of the husband was not proven. The husband appealed this decision in the High Court.
Husband's allegation – wife used to keep three SIM cards
The husband told the High Court that three SIM cards were found on his wife during a social gathering in November 2022. After reconciliation, the two lived together for some time. He alleged that on March 16, 2023, his wife threatened to implicate him in a false dowry and witchcraft case. This led to a dispute between the two. His wife later left him and went to her parents' home.
The wife said she wanted to live with her husband.
The wife denied all the allegations, stating that her husband had been having a dispute with his brother, and that they wanted to live separately. Later, when the dispute arose, her husband began making false accusations to try to leave her. She told the court that she was still willing to live with her husband.
Husband could not provide evidence of mental cruelty
After hearing both sides, the High Court dismissed the husband's appeal, stating that under the law, cruelty is not proven due to lack of evidence, and that even if an incident had occurred, the husband had forgiven her.
According to the provision, if cruelty is condoned, it is not grounds for divorce. The couple lived together from November 2022 to March 29, 2023, which clearly shows that the husband condoned any alleged cruelty.

Barse Deva, the commander of the Naxalite battalion number 1 in Bastar, Chhattisgarh, may surrender.
Barse Deva, the commander of the Naxalite's most dangerous battalion, No. 1, in Bastar, Chhattisgarh, may surrender. It is being reported that a safe corridor is being prepared for him in the Sukma area to exit the jungle. If Barse Deva surrenders, the Naxalite's most dangerous military wing, the PLGA Battalion No. 1, will be virtually destroyed.
In fact, on November 18th, Madvi Hidma, a Central Committee member of the Naxalites, was killed in an encounter in Alluri Sitarama Raju district of Andhra Pradesh. Following Hidma's encounter, the Naxalite organization in Bastar has been shattered. Hidma was the only link that held the Maoist organization together with Bastar.
Hidma and Barse Deva both belonged to the same village.
Hidma was a resident of Poorvarti village. Barse Deva, also from Poorvarti village in Sukma district, also hailed from the same village. About two years ago, when Hidma was inducted into the Central Committee, he appointed Barse Deva as the commander of PLGA Battalion No. 1.
Deva had a large number of Naxalites with him. But now, due to increasing police pressure and frequent encounters, the battalion has almost disbanded.
Battalion has more influence in 3 districts
Naxalite Battalion No. 1 is considered the most dangerous unit of the Naxalite organization. The battalion has had significant influence in the three districts of Dantewada, Bijapur, and Sukma. However, the armed forces have now significantly put this unit on the back foot. This unit comprised hundreds of Naxalites armed with weapons such as AK-47s, INSAS rifles, SLRs, and sniper guns.
This same Naxalite team carried out major attacks in Tekalgudem, Burkapal, Minpa, Tadmetla, and Tahkwara, resulting in the martyrdom of hundreds of soldiers. However, this team has now become weak. Deva is now seeking to surrender.
It is also known that he has sent his message abroad through some channel. If Deva surrenders, his battalion will be disbanded. There will be no Naxalite to lead it.
This is Deva's profile
Deva Barse (48), also known as Hemla Deval, Devlu alias Devanna, Barse Sukka, and Sainath, is a SZCM cadre in the Naxalite organization. He is currently in charge of PLGA Battalion 1.
He is also a member of the South Sub-Zonal Bureau. He carries an AK-47 weapon. The Chhattisgarh government has announced a reward of approximately 2.5 million rupees for his arrest.
The Home Minister met his mother
In fact, Chhattisgarh Home Minister Vijay Sharma visited Poorvarti village a few days ago. There, he met the mothers of Deva and Hidma and through them, appealed to them to surrender.
Hidma, however, refused to budge and was killed in a police encounter in the forests of Andhra Pradesh, along with his wife Raje and six companions. Deva Barse is now attempting to surrender in Chhattisgarh.
7 out of 15 area committees remain, division also ends
According to Bastar IG Sundarraj P, a total of seven divisions and 15 area committees of Naxalites were active in Bastar. Naxalites have been virtually eliminated in the Maad division, Keshkal, and Darbha divisions.
There are some Naxalites in the West Bastar Division. But now only a few isolated Naxalites remain in the seven Area Committees. Only 120 to 150 armed Naxalites are active in the Dandakaranya region. If these Naxalites are eliminated, Naxalism will be virtually eradicated.

Chhattisgarh High Court's decision: Nomination is not sufficient for succession
The Chhattisgarh High Court has clarified that nomination in a bank does not create inheritance rights ; the nominee is merely the custodian of the deposit, not the owner. This order came in a dispute over a ₹1.5 million deposit with the Bank of India, Mungeli. Following the death of health worker Ranjanadevi Pradhan, both her son-in-law, Rahul Dhruv, and father-in-law, Lallaram, claimed the deposit. The trial court, upon reviewing the nomination, ordered the money to be given to the son-in-law, but the district court granted primary rights to Lallaram, a close relative, under the Hindu Succession Act. Citing Supreme Court decisions, the High Court upheld the appellate court's order, dismissing the revision petition, and affirmed Lallaram's right to the ₹1.5 million deposit .

Rising GDP is a clear indication that every person in India is now becoming economically empowered: CA Amit Chimnani
Reacting to the Indian economy's GDP growth rate of 8.2 percent in the second quarter, BJP spokesperson CA Amit Chimanani said that this is a matter of pride for India. The entire world is experiencing instability. There has been a prolonged war between Russia and Ukraine, tensions between Pakistan and Afghanistan, coups in Nepal and Bangladesh, and tensions between the United States and China. India has magically protected itself from all these negative impacts, a feat only possible through Modi's magic.
CA Amit Chimanani said that India is experiencing a massive boom in all sectors. There is tremendous growth in agriculture, manufacturing, construction, and services. Along with the country's accelerating economic growth, this is also proof that every person in the country is becoming financially stronger. People's purchasing power is increasing, and people are living better lives than before. CA Amit said that after the US announced large tariffs, the opposition, as usual, began creating a negative atmosphere for the country, but India is now working under strong leadership. The opposition also needs to refrain from pursuing an anti-national agenda.
CA Amit Chimanani said that on one hand there is record GDP growth and on the other hand inflation is the lowest in 13 years, this is no less than a miracle. This is the result of the visionary thinking of Prime Minister Shri Narendra Modi and the continuous reforms being carried out in the economic sector. During the 10 years of UPA and Congress rule, India's economy could not move even a step ahead from the 11th economy of the world, inflation had broken all records, but under the Modi government, we are the fourth largest economy of the world and soon we will be the third largest economy of the world. Chhattisgarh is also contributing immensely in the economic development of India under the leadership of Vishnu Dev Sai government of Chhattisgarh.
